How to complete The Patent Holder

Filing a patent means converting an idea into a legally defensible claim that no one else can make, sell, or use without your permission. The real work is documenting what is genuinely novel and non-obvious, then writing claims narrow enough to be granted but broad enough to be worth holding.

1. Run a prior-art search on Google Patents and Espacenet before spending a cent: most ideas are already filed, and finding that out early saves thousands
2. Keep a dated, witnessed invention notebook documenting how and when you built the thing
3. File a provisional application (US) or equivalent to lock in a priority date cheaply while you refine the full spec
4. Draft independent and dependent claims with a patent attorney: claim wording, not the description, is what gets enforced
5. Decide national vs international early: file a PCT application within 12 months of priority if you want global reach

Tips

• Public disclosure (a demo, a paper, a Kickstarter) can destroy patentability in many countries, so file before you reveal
• Provisional buys you a year and a priority date for a few hundred dollars; use it to test the market before the expensive non-provisional
• Budget for prosecution: the real cost comes in attorney back-and-forth with the examiner, not the filing fee
